By accessing or using FormTrackr ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

FormTrackr is a lead tracking and attribution platform that allows you to capture form submissions, track lead sources, and upload conversion data to Google Ads. The Service includes web tracking snippets, data collection and storage, analytics dashboards, and integration with third-party advertising platforms.

3. Account Registration

To use the Service, you must:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You are responsible for maintaining the confidentiality of your account and password. We reserve the right to suspend or terminate your account if any information provided is inaccurate, not current, or incomplete.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe upon the rights of others
  • Transmit any malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers

7. Fees and Payment

Certain features of the Service may be subject to fees. If you purchase a paid subscription:

  • Fees are billed in advance on a recurring basis
  • All fees are non-refundable unless otherwise stated
  • You authorize us to charge your payment method for all applicable fees
  • We reserve the right to change our pricing with reasonable notice
  • Failure to pay may result in suspension or termination of your account

8. Intellectual Property

The Service and its original content, features, and functionality are owned by FormTrackr and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

9. Service Availability

We strive to provide a reliable and available Service, but we do not guarantee that the Service will be available at all times or that it will be error-free. We may experience downtime due to maintenance, updates, or unforeseen circumstances. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FORMTRACKR, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

12. Indemnification

You agree to defend, indemnify, and hold harmless FormTrackr and its affiliates, officers, agents, and employees from and against any claims, suits, proceedings, disputes, demands, liabilities, damages, losses, costs, and expenses, including reasonable attorney's fees, arising out of or relating to your use of the Service, Your Data, your violation of these Terms, or your violation of any rights of another.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete Your Data in accordance with our data retention policies
  • All provisions of these Terms that by their nature should survive termination will survive

You may terminate your account at any time by contacting us or using the account deletion features in the Service.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FormTrackr operates, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between you and FormTrackr regarding the Service.
